Explicit Consent Text

This section contains the consent texts for the processing and transfer activities that require explicit consent under KVKK art. 5/1 and art. 9, and for the sending of Commercial Electronic Messages within the framework of Law no. 6563 on the Regulation of Electronic Commerce. Giving consent is not a condition of shopping on the Site; if you do not give consent, the cookies and communication within the relevant channel are disabled.

1. Explicit Consent Text for Marketing, Analytics and Profiling

By giving explicit consent to the data processing and transfer activities set out below, you accept, declare and approve the following:

• That cookie-based usage analysis is carried out and conversion data is collected on the Site through Google Analytics 4 and Meta Pixel.

• That limited profiling and targeted advertising (remarketing) is carried out on the basis of anonymous/pseudonymous identifiers (cookie identifiers, IP address, device information). Profiling is limited to advertising personalisation and conversion measurement; it is not used for the purpose of automated decision-making producing an adverse effect on you.

• That the data processed within that scope is transferred abroad by Google LLC and Meta Platforms Ireland Ltd. and processed on servers located abroad; the transfer is based on the Standard Contract (SCC) published by the Personal Data Protection Board and on the technical and administrative measures taken under KVKK art. 12 (TLS encryption, access control, IP anonymisation, provider compliance checks).

• That, in communication conducted over WhatsApp Business, data such as message content and telephone number may be transferred abroad by Meta and processed on infrastructure located abroad; and that this transfer is likewise made under the SCC together with technical and administrative measures.

• That you may withdraw your explicit consent at any time: for marketing communication from the My Communication Preferences page, for cookie preferences through the “Cookie Settings” link in the Site footer, and for other matters by applying to merhaba@espeki.com.tr. Withdrawal does not affect the legal consequences of processing carried out before the date of withdrawal.

2. Reserve Explicit Consent for Transfer Abroad

In some cases the Standard Contract method may not on its own be sufficient. In that case the transfer of your data abroad may be carried out on the basis of your explicit consent, obtained separately. You give your explicit consent by approving the cookie notice with the “Accept All” option or by ticking the relevant box during the checkout or membership process. You may withdraw your consent to this consent-based transfer at any time.

3. Commercial Electronic Message (TEM / İYS) Permission Text: Preparatory Version

This section has been prepared for the commercial electronic message activity to be activated in future. Before the system is activated, our sender account will be created on the Message Management System (İYS) and the consents will be uploaded to İYS.

If you give commercial electronic message consent, you accept and approve the following:

• That commercial electronic messages containing products, campaigns, discounts, surveys, events and reminders offered by ESRA PERUZE KIZILTUĞ TİNER, ESPEKİ are sent to you by e-mail, SMS and/or WhatsApp.

• That your contact details (e-mail address, telephone number) are processed for this purpose.

• That your commercial electronic message consents are recorded with İYS within 3 (three) business days of the date they are obtained, under the Regulation on Commercial Communication and Commercial Electronic Messages.

• That you may withdraw your consent at any time, free of charge and without giving a reason; you may withdraw through the “refusal notice” link contained in every message, the My Communication Preferences page, the merhaba@espeki.com.tr e-mail address or the İYS portal (iys.org.tr).

• That the consent date, channel and message type information is uploaded to İYS.

4. General Information on Explicit Consent

• Explicit consent is always given by free will; if you do not give it, your right to benefit from the essential services of the Site is not affected.

• When explicit consent is withdrawn, the relevant processing/transfer activity is stopped as from the date of withdrawal.

• Data within the scope of explicit consent is processed within the retention periods set out in the KVKK Privacy Notice.
